Court affirms “Civil courage in the face of right-wing extremism” and simultaneously maintains the occupational ban of “radicals”

Massive human rights violation as well as contravention of the Treaty on European Union and the European Convention on Human Rights.

Tobias Pflüger, MdEP from Baden-Württemberg and member of the Left fraction (GUE/NGL), responds to today’s announcement of the administrative court’s judgement in the case of the secondary school teacher from Heidelberg, Michael Csaszkóczy, which rejected his claim against the ban from the civil service, which has been imposed against him:

The action undertaken to ban Michael Csaszkóczy from the civil service has crossed the line of absurdity. It is simply more than peculiar that, on the one hand the local education authority as well as the court attest to the teacher’s “peaceable nature and civil courage in the face of right-wing extremism”, and yet on the other hand, the undemocratic practice of occupational banning is maintained in the judgement of the very same hearing precisely because of this moral courage.

The court contravenes the right to freedom of occupational choice, as laid down in the Treaty on European Union, and the EU anti-discrimination policy. At the same time the judgement violates the European Convention on Human Rights, which guarantees freedom of occupation. In 1995 the European Court of Justice deemed the occupational ban a violation of human rights.

Such bans were already scandalous in the peak period after the so-called Radicals Decree (Radikalenerlass) and are completely out of place today. It is a path leading back to a grim past. The case against Michael Csaszkóczy in Baden-Württemberg has provided a lasting reminder for the present-day Federal Education Minister Annette Schavan, that she is essentially responsible for spoiling his prospects for the future.

Amongst the accusations made about Michael Csaszkóczy, the central issue is so-called “guilt by contact”, as the court cites no evidence whatsoever of a misdemeanour of any nature. Michael Csaszkóczy has been accused on the basis of his commitment to the Anti-Fascist Initiative Heidelberg alone. The punishment of the absolutely vital dedication to fighting fascism and racism must come to an end once and for all.

The state of Hesse endorsed the imposed occupational ban in Baden-Württemberg in 2005 and verified another ban in Hesse last Wednesday (08.03).

Michael Csaszkóczy’s, now rejected claim against the imposed ban on the teacher is a great step in the direction of civil rights restrictions. It is imperative to counter these human rights violations and so I support the nation-wide demonstrations against occupational bans on the 25.3.2006 in Karlsruhe.
